JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-01-2017 After some argument, the counsel for the petitioner submits that the petitioner is ready to deposit 50% of the alleged amount with condition that it will not prejudice the case of the petitioner in the court concerned. He further submits that some reasonable time may be granted to the petitioner so that she could deposit the aforesaid amount.

Heard learned Additional Public Prosecutor as well as the informant and they have no objection to the aforesaid proposal.

In view of the aforesaid fact, let the petitioner, Pratibha Prasad surrender before the court below on 14.02.2017 with a Demand Draft of Rs. 4,00,000/- (Rs. four lacs). If such

No.24176 of 2016 (10) dt.30-01-201 2/2 amount is deposited on such date, the court below will release the petitioner on provisional bail to his own satisfaction with condition that the rest amount, i.e. Rs. 4,00,000/-, will be deposited by the petitioner on or before 15.03.2017 in the court below, and amounts so deposited will be released in favour of the complainant.

The aforesaid amount shall be released in favour of the complainant with the condition that if he fails in his case, he will return the aforesaid amount.

The provisional bail granted to the petitioner will be confirmed by the court below if the full amount will be deposited by the petitioner, and deposit of the above amounts shall not prejudice the case of the petitioner in the court below. With the above observation/direction, this petition is allowed.
