ANJANA MISHRA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 12.3.2014 in Nawada Town P.S. Case No.562 of 2013 for the offence under Section 384 of the I.P.C.
It is submitted on behalf of the petitioner that the F.I.R. of the present case was registered against unknown persons but subsequently after he was taken into custody in connection with Nawada Town P.S.Case No.5 of 2012. On 3.1.2014 he was remanded in three different cases on the basis of confessional statement of co-accused persons. It is further submitted that the petitioner cannot be prosecuted on the basis of only confessional statement made before the police by co-accused persons as the
Patna High Court Cr.Misc. No.34799 of 2014 (3) dt.08-01-2015 2/2 same has no evidentiary value in the eye of law. Considering the aforementioned submission and also that no specific case is made out against the petitioner, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada, in Nawada Town P.S.Case .No.562/13.
