JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Eight persons including the petitioner are named in the first information report and there is omnibus allegation against all of them. The F.I.R named accused persons assaulted the deceased by different weapons and when the informant and one other came to rescue the deceased, they were also assaulted by them. In course of investigation, the informant in his further statement stated that first blow on the deceased was given by F.I.R named accused Awadhesh Kumar and the statement of the aforesaid witness was corroborated by witness Hira Mahto at para25 of the case diary in which the aforesaid witness stated that it
Patna High Court Cr.Misc. No.35427 of 2015 (4) dt.10-12-2015 2/2 was co-accused Awadhesh Kumar, who gave maximum blows to the deceased. The post mortem report of the deceased reveals that altogether five incised wounds were found on the person of deceased but according to witness Hira Mahto maximum wound on the person of the deceased had been given by co-accused Awadhesh Kumar.
Considering the aforesaid facts and circumstances as well as this aspect of the matter that three co-accused having more or less similar allegation have already been granted privilege of bail, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Sangrampur P.S.case No. 28 of 2015.
