Case No. 73 of 2014, registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code. Petitioner happens to be father-in-law and case is of dowry death. It further appears that case is of the year 2014 and petitioner is named in the FIR. However, he has appeared in the year 2019.
Submission of learned counsel for the petitioner is that other two accused persons, including husband of the deceased have been acquitted after trial and petitioner is in custody since 23.11.2019.
Heard learned APP, who has opposed the prayer for bail stating that as the petitioner was absconding trial of other accused persons was separated as such he does not deserve bail.
Patna High Court CR. MISC. No.5610 of 2020(2) dt.03-02-2020 2/2 In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. This application is, accordingly, dismissed.
