====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 03-04-2019 Heard learned counsel for the petitioner, counsel for the State as also counsel for the Bank.

In this case, the petitioner has already moved this Court in Cr. Misc. No.20619 of 2017 and this Court, vide order dated 12.09.2018, rejected the prayer for anticipatory bail of the petitioner. Again, the petitioner has approached this Court for grant of anticipatory bail having stated that he is ready to deposit 50% of the up-to-date outstanding due within a period of six weeks from the date of release of the petitioner. In view of the submission made above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on provisional bail on furnishing bail bond of

Patna High Court CR. MISC. No.6198 of 2019(3) dt.03-04-2019 2/2 Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 237 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.

It is made clear that if the petitioner deposits the 50% of the up-to-date outstanding due within a period of six weeks from the date of his release on provisional bail, the provisional bail, granted today to the petitioner, will be confirmed but, in failure to deposit the same within the aforesaid period of six weeks from the date of his release, the present order, granting provisional bail to the petitioner, shall be treated to have been withdrawn.
