Petitioners are aggrieved by the quantum of compensation paid to them after acquisition of their land by the State Government for construction of power station. Annexure 1, is the compensation amount as determined by the competent authority and same has been received by petitioners, however, they are aggrieved by the quantum of compensation. It has been contended that nature of land is residential and there are structures standing upon them for which no compensation has been paid and compensation amount which

Patna High Court CWJC No.4565 of 2018 dt.22-05-2019 2/2 was paid to them is inadequate and they want enhancement of the compensation amount of the residential land and also for compensation on the structure standing over said land for which they have already filed a petition pending before the District Land Acquisition Officer, Aurangabad being Land Acquisition Case No.01/2016 which is pending for consideration by the District Land Acquisition Officer.

In the facts and circumstances of the present case, the writ petition is disposed of with a direction to the District Land Acquisition Officer, Aurangbad, respondent no.2 to consider the grievances of petitioner with respect to the enhancement of compensation amount and nature of acquired land and decide the same within six months from the date of receipt/production of a copy of this order after hearing all the concerned parties in accordance with law.
