The petitioners are apprehending their arrest in connection with Asaon P.S.Case no.109/18 , registered for offences punishable under Sections 341, 323, 325, 379, 307, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant and the specific allegation is against the petitioner no.1of assault by Farsa on head of Arvind Tiwary. Submission of the learned counsel for the petitioners is that there is case and counter case and no specific allegation has been attributed against any one.

Heard learned A.P.P., who has opposed the prayer for bail

Patna High Court CR. MISC. No.6591 of 2019(3) dt.02-04-2019 2/2 stating that there is specific allegation against the petitioner no.1 of assault by Farsa and the injury to Arvind Tiwary is grievous in nature that is on head..

Having heard both sides and in view of the facts and circumstances, as stated above, so far the petitioner no.1 Ravi Kant Yadav @ Ravi Shankar Yadav is concerned, I am not inclined to grant bail to petitioner no.1 as such his prayer for bail is rejected. However, so far petitioner no.2 Munna Yadav is concerned , in the event of arrest or surrender before the court below within a period of six weeks from the date of order petitioner no.2 be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Asaon P.S.Case no.109/18, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is disposed of.
