The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324,307,504,506 and 379 of the IPC and Section 27 of the Arms Act.
The prosecution case as per the fardbeyan of Kishore Prasad recorded by SI Shyam Singh on 28.10.2019 at 2.30 P.M. is to the effect that on 27.10.2019 at 9.00 A.M. the informant noticed that 10-15 persons were gambling. When the informant made protest and threatened to inform the police, consequently, some hot exchange took place between them. In this background, 23 FIR named accused persons came variously armed at the door of the informant and started assaulting. It is alleged that petitioner no. 7 Pawan Kewat assaulted with sword on the head of the informant causing cut injury. When the informant's cousin Suresh Prasad and grand son Kaushal Kumar came to rescue, then co-accused Sanjay Kewat assaulted Kaushal Kumar with an iron rod. Thereafter, petitioner no. 6 Shiv Shankar Kewat took away Rupees two thousand five hundred from the informant and petitioner no. 3 Gaya Kewat took away a gold locket from the neck of Kaushal Kumar.

No.4400 of 2020(2) dt.28-02-2020 3/3 It is submitted by learned counsel for the petitioners that the accusation is omnibus and general and for petty dispute, the accusation has been levelled against the petitioners. It is further submitted that for the alleged occurrence of 27.10.2019, the FIR was registered on 29.10.2019 and none has received any grievous injury. The petitioners are accused in one another case apart from the present one.
Learned APP submits that the petitioners are named in the FIR.
Considering the omnibus and general accusation against the mob, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Hilsa, Nalanda in connection with Karaiparsurai P.S. Case No. 153 of 2019 subject to the conditions laid down in Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) anil/- U
