Petitioner is named in the first information report but only suspicion was raised against him. Moreover, in course of investigation, some witnesses stated that co-accused persons, who executed the present crime, had stayed in the house of the petitioner prior to the alleged occurrence and, therefore, even if the aforesaid statements of prosecution witnesses assumed to be true, then also, petitioner is said to be conspirator only and admittedly, he had not taken active part in committing the murder of the deceased.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.34419 of 2015 (2) dt.28-08-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Pakribarawan P.S. Case No. 103 of 2014.
