Patna High Court CR. MISC. No.16593 of 2021(2) dt.07-01-2022 2/3 the learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Chautham P.S. Case No. 129/2020 instituted for the offence under Sectionss 147, 148, 149, 341, 323, 307, 504, 506, 379 of the Indian Penal Code and Section 27 of the Arms Act.
Because of a dispute between the ladies of two households, an occurrence took place in which several persons are said to have participated.
Though, the petitioners have been named in the F.I.R. but no overt act has been attributed against them. Firing also is said to have been resorted to, but it is not attributed to the petitioners.
Some personal belongings of the family of the informant were also sated to have been snatched away. There is a counter version of the occurrence vide Chautham P.S. Case No. 130 of 2020.
The parties have decided not to prosecute each other for the reason that the occurrence arose out of a trifle. So far as the petitioner are concerned, there is no
Patna High Court CR. MISC. No.16593 of 2021(2) dt.07-01-2022 3/3 specific accusation as noted above and only Gopal Sah and Suman Sah are said to have assaulted the victims. The victims, according to the information of the learned counsel for the petitioners, have also received simple injuries.
Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Khagaria, in connection with Chautham P.S. Case No. 129/2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
