2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 109, 3(5), 126, 115(2) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. Prosecution case, in brief, is that on 2.9.24 at about 6:30 PM, while informant demanded the due rent from this petitioner, who is the tenant of informant, this petitioner called four unknown persons on mobile and all of them assaulted informant. It is further alleged that this petitioner caught collar of the informant and two of them fired with intention to kill him. During investigation, involvement of this petitioner in the alleged incident is recorded in the CCTV camera.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation

Patna High Court CR. MISC. No.7724 of 2025(2) dt.20-02-2025 2/2 of assault is general and omnibus and there is no allegation of specific overt act against petitioner. Petitioner claims clean antecedent.

5. Considering the fact that petitioner and other accused persons were seen in the CCTV footage, while firing with the gun, prayer for anticipatory bail of the petitioner is refused.
