The petitioner is languishing in custody for the offences punishable under Sections 8/20(b)(ii)(B)/25/29 of the N.D.P.S. Act.

Perused the explanation of the court below.

The court below is directed to remain careful in future while applying the law in similarly situated cases. It appears that the court below has already granted bail to co-accused Nirju Kumar from whose house 7 kg and 290 gm of Ganja was recovered. Prayer of the petitioner was refused as 5 kg and 150 gm of Ganja was recovered from the house of the petitioner. However, the petitioner had one identical criminal antecedent. Petitioner is in custody since 14.12.2020.

No.17051 of 2021(3) dt.04-10-2021 2/2 Considering recovery of more than small quantity and less than commercial quantity and grant of bail to co-accused by the court below itself, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Goh P.S. Case No. 181 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
