The petitioner is in custody in connection with Ramkrishna Nagar P.S. Case No. 531 of 2018, Special Case No. 11391 of 2018, registered for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case total20.250 liters liquor was recovered from two plastic bags. Learned counsel for the petitioner further submits that nothing was recovered from the physical possession of the petitioner and he is in custody since 30.11.2018.
