The petitioner seeks bail in Siwan Muffasil P.S. Case No. 63 of 2020, registered for the offence punishable punishable under Sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2018. 358.560 litres of illicit liquor has been recovered from toilet of this petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from toilet which is situated in open place which is accessible to general public. Petitioner has got no concern with the seized liquor. Petitioner is in custody since 09.12.2021 having no

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge 2nd-cum-Special Judge Excise, Siwan in connection with Siwan Muffasil P.S.
