Petitioner is accused in connection with Alamnagar P.S. Case No. 166 of 2015 registered under Sections 385, 386 and 34 of the I.P.C.

The accusation is that this petitioner along with coaccused Tinku Kumar Singh started abusing to the informant Binod Kumar Bhagat and made demand ransom of Rs. 2 Lakhs as due to giving evidence by him in the case of Pappu Jaiswal, they have suffered loss of Rs. 2 lakhs. At that time, both assaulted to informant and snatched his gold chain and cash of Rs. 21,000/-. Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case along with

Patna High Court Cr.Misc. No.25040 of 2016 (3) dt.03-08-2016 2/2 co-accused due to business rivalry. It is further submitted that petitioner is in custody since 27.04.2016 and similarly situated coaccused Tinkoo Kumar singh @ Dhananjay Singh @ Tinkoo Singh has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 5758 of 2016 on 17.02.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Uda-Kishunganj, District - Madhepura in connection with Alamnagar P.S. Case No. 166 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner, who will file an affidavit showing his relation with the petitioner and further the petitioner shall remain present on each and every date during the course of trial in the Court below. If the petitioner fails to remain present on two consecutive dates during the course of trial without any reasonable cause, the Court concerned would be at liberty to take steps for cancellation of his bail bonds.
