The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 293 of 2021 instituted for the offences under Sections 30(a) and 41(2)(1) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 09.11.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 411.84 litres of liquor from a pickup van.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and he came to be implicated based on the fact that he is the owner of the pickup van, further the petitioner was not knowing what the driver was

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Samastipur in connection with Kalyanpur P.S. Case No. 293 of 2021.
