This application, for grant of anticipatory bail, arises out of Gaighat Police Station Case No. 392 of 2021, dated 31.10.2021, disclosing offences under Sections 306/34 of the Indian Penal Code.
The prosecution case, as per the First Information Report, is that the informant's son committed suicide due to the insult caused to him in his in-laws' house.
Learned Counsel for the petitioners submits that the petitioner nos. 1 and 3 are the wives of the elder brother-in-laws
Patna High Court CR. MISC. No.6593 of 2023(2) dt.18-05-2023 2/3 of the deceased and petitioner no. 2 is the daughter of petitioner no. 1. He further submits that the deceased was in depression and he has committed suicide at his own house and not in the house of the petitioners. He further submits that the father-inlaw of the deceased has been granted anticipatory bail by the learned Court below, which would be evident by the impugned order itself.
On the other hand, learned Additional Public Prosecutor submits that the suicide note was left by the deceased, which has been found by the police in course of investigation.
Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that the father-in-law of the deceased has been granted anticipatory bail by the learned Court below itself and the petitioners are the wives and daughter of the brother-in-laws of the deceased, I am inclined to grant the petitioners privilege of anticipatory bail. This application is, accordingly, allowed.
Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of
Patna High Court CR. MISC. No.6593 of 2023(2) dt.18-05-2023 3/3 the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Gaighat Police Station Case No. 392 of 2021, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
