According to prosecution case itself, it was coaccused, Ramnandan Singh who opened fire on the deceased and so far as petitioner is concerned, he happens to be only a member of unlawful assembly.
No doubt, petitioner carries criminal antecedent but submission on behalf of the petitioner is that there was land dispute between the parties and as a matter of fact, all the cases were lodged against the petitioner by the prosecution party of the present case. Moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail by
Patna High Court Cr.Misc. No.36104 of 2015 (2) dt.07-09-2015 2/2 different Benches of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri D.K. Mishra, Judicial Magistrate 1st Class, Patna City in connection with Fatuha P.S. Case No. 433 of 2014. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
