The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 399, 402, 411, 412 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act.

The prosecution case in nutshell is that informant being a police official received a secret information that some miscreants have assembled and preparing for committing the offence. On raid, one loaded country made pistol and mobile was recovered

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that petitioner has no concern with other coaccused persons and he was going to purchase medicine and in that course unfortunately his motorcycle was dashed with road divider and he was apprehended by the police and made accused in the present case. It is submitted vide para 9 of the petition that the mobile recovered from the possession of the petitioner is not looted or stolen article and no any arms or ammunition were recovered from his possession. Moreover, the petitioner is languishing in judicial custody since 12.07.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties

Patna High Court CR. MISC. No.6272 of 2023(2) dt.11-04-2023 3/3 and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sakra P.S. Case No. 357 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Muzaffarpur.
