The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 149, 447, 452, 435, 120(B), 384, 379, 436 of the Indian Penal Code, Section 13 of GAP Act and Section 17 of CLA Act. Allegation against the petitioner and other coaccused persons is that they ablaze the tractor and office of brick kiln of informant.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has
Patna High Court CR. MISC. No.14454 of 2023(2) dt.27-04-2023 2/3 falsely been implicated in the present case. Petitioner is not named in F.I.R. His name sprang up on the basis of confessional statement of co-accused Mantun Paswan, who has already been granted bail vide order dated 15.06.2015, passed in Cr. Misc. No. 18346 of 2015 by the co-ordinate Bench of this Court. Nothing incriminating has been recovered from the conscious possession of the petitioner. Moreover, the petitioner is languishing in judicial custody since 18.12.2022. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Hajipur Sadar P.S. Case No. 462 of 2014 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
