The petitioner seeks bail in connection with N.D.P.S. Case No. 93 of 2021, arising out of Paroo P.S. Case No. 250 of 2021, registered for the offence under Sections 399, 402, 414/34 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act.

As per prosecution case, one country-made pistol with five live cartridges and cash of Rs. 10,000/- having stamp of SBI has been recovered from the possession of the petitioner. It is submitted on behalf of the petitioner that no recovery has been made from the conscious possession of the petitioner. No narcotic substance have been recovered from the conscious possession of the petitioner and he is in custody since 15.07.2021. Investigation is complete.

Patna High Court CR. MISC. No.7134 of 2022(2) dt.07-04-2022 2/2 Learned APP for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge Vth cum Special Judge, N.D.P.S.Act, Muzaffarpur, in connection with N.D.P.S. Case No. 93 of 2021, arising out of Paroo P.S. Case No. 250 of 2021.
