JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named and for the first time, name of the petitioner came at paragraph-89 of the case diary in which, one witness expressed his suspicion against the petitioner and others. After that, one co-accused was arrested and made his confessional statement leading to recovery of looted articles. So far as petitioner is concerned; except the suspicion of the aforesaid witness as well as confessional statement of co-accused, there appears to be nothing against him.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection

Patna High Court Cr.Misc. No.35293 of 2015 (4) dt.02-11-2015 2/2 with Pothia (Paharkatta) P.S. Case No. 95 of 2012 to the satisfaction of Chief Judicial Magistrate, Kishanganj.
