2. The petitioner has prayed for bail in connection with Nauhatta P.S. Case No. 191 of 2025 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 127(2), 115(2), 109(1), 140(2), 303(2), 352, 351(3), 61(2) of the B.N.S., 2023 and Sections 25(1-b)(a), 27, 35 of the Arms Act.
3. The case of the prosecution in short is that altogether sixteen persons arrived at the house of the informant being armed with weapon. It is alleged against this petitioner that he had called on mobile of Avinash Singh and Avinash Singh disclosed that this petitioner has told him to give rifle to Avinash and make a video and send the same to this petitioner which will be shown to the M.L.A and on his instruction, Vikash

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Learned counsel for the petitioner submits that there is no allegation against this petitioner of any assault. Other co-accused persons who were having allegation of assault have been granted bail by this court vide Cr. Misc. No. 75628 of 2025. The case of this petitioner stands on better footing. Moreover, petitioner is languishing in judicial custody since 23.11.2025.
5. The application for bail is opposed by learned APP for the State and has submitted that petitioner is having criminal antecedent of eight cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Dehri on Sone, Rohtas in connection with Nauhatta P.S. Case No. 191 of 2025 with following conditions:- (i) The petitioner shall cooperate in trial and shall remain physically present in the trial court on each and every fixed date.
