The petitioner seeks bail in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant Munna Yadav alleged that when he was going on motorcycle along with his friends Chote Lal Yadav and the deceased Pappu Khan, Gopal Mandal (the petitioner), Sumit Singh and Sonu Kumar Jha and others surrounded them. Tidda Yadav threatened to kill the deceased. On such, Sonu Kumar Jha handed over loaded pistol to Tidda Yadav who fired at Pappu Khan killing him and there is no allegation of firing against this petitioner. Similarly, situated co-accused Sumit Singh, Pankaj Mandal and Sonu Kumar have already enlarged on bail.

Patna High Court Cr.Misc. No.34614 of 2015 (2) dt.20-08-2015 P2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, 1st Class, Bhaaglpur in connection with Kahalgaon P.S. Case No. 412 of 2014.
