The petitioner is in custody since 7-7-2013 in connection with Patrakar Nagar P.S. Case No. 129 of 2013. The trial in this case bearing Sessions Trial No.1285/13 is well under progress and out of four charge sheeted witnesses, three have already been examined and the doctor is yet to be examined for which summons has already been issued in the month of January, 2015. Earlier, report was called for by this Court which has been placed on record. From perusal of the same, it appears that there is every likelihood that the trial will be concluded shortly. In the facts and circumstances of the case, since the

No.35798 of 2014 (4) dt.02-03-2015 2 / 2 depositions of the victim girl as well as her mother do not indicate or support the prosecution story, let the petitioner Chintu Kumar @ Avinash Kumar be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Patna, in connection with Patrakar Nagar P.S. Case No. 129 of 2013. It is, however, directed that the petitioner will co-operate in conclusion of the trial and be present on each date so as to facilitate conclusion of the same within a period of six months positively.
