JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 01-11-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In the present case, petitioner is challenging the action of the department in issuing advertisement for appointment of service provider for the purposes of supply of power and provide facility to patients in the Sadar Hospital and in various Primary/Additional health Centre in the district of Nalanda. The job of service provider is to supply of uninterrupted power as well as other facility to the patients who were/are

Patna High Court CWJC No.11092 of 2017 dt.01-11-2017 inducted. Altogether petitioner has entered into four agreements for Sadar Hospital and different Primary/Additional Primary Health Centre. The first agreement is/was with respect to Sadar Hospital for three years has completed on 25.8.2017 and rest three agreements which have been entered into by the petitioner with the State Health Society for three years on 7.4.2015 which would come to an end on 6.4.2018.

So far first agreement is concerned, the period is already over and it has been informed at the Bar that petitioner has also participated in the tender. So far 2nd, 3rd and 4th agreement are concerned it would come to an end on 6.4.2018. The authority may continue with exercise of appointment of new incumbents but it will take effect after 6.4.2018 as earlier three agreements would come to an end on 6.4.2018.

With the aforesaid observation and direction this writ petition is disposed of.
