JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 This is an application for grant of anticipatory bail in connection with Doriganj P.S. Case No. 145 of 2018, disclosing offences under Sections 366-A of the Indian Penal Code. Allegation as per F.I.R. is of kidnapping of the minor daughter of the informant by one Raj Kumar and his son Shashi Kumar. Petitioner is not named in the F.I.R., later on her name transpired during the course of investigation. Submission of learned counsel for the petitioner is that she has made accused in this case only because that she is the wife of Raj Kumar and mother of Shashi Kumar and except that nothing has been attributed against her. Further, she has no criminal antecedent.
Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of
Patna High Court CR. MISC. No.6181 of 2019(3) dt.01-04-2019 2/2 the petitioner.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Chapra, District Saran, in connection with Doriganj P.S. Case No. 145 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
