Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. No doubt, petitioner carries criminal antecedent of two cases but in the present case, except confessional statement of co-accused, there appears to be nothing against him.

Learned counsel for the petitioner points out that the petitioner is not an accused in Khaira P.S. Case No. 109 of 2015 and as a matter of fact, the learned Additional Sessions Judge has committed error on record. Considering the facts and circumstances of the

No.33794 of 2015 (3) dt.25-08-2015 2/2 case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chandramandih P.S. Case No. 28 of 2015 to the satisfaction of Sri Amit Kumar Singh, J.M.-Ist Class, Jamui.
