JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2022 Heard Ms. Mukul Kumari, learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh, the learned APP. The petitioner seeks bail in anticipation of his arrest in connection with Fesar P.S. Case No. 82 of 2020 dated 04.08.2020 instituted for the offences under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code. The petitioner and about 14 others are said to have assaulted the members of the prosecution party. So far as the petitioner is concerned, he is stated to have snatched money and gold ring from the possession of the informant and his family members. The accusation, it has been argued, is absolutely vague and appears to be concocted.

The injuries suffered by the victims of the subject FIR have been reported to be simple in nature.

Both sides have received injuries and the injuries on every victim is reported to be simple in nature. All other accused persons of this case have earlier been granted bail by this Court.

Considering the afore-noted background facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Fesar P.S. Case No. 82 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
