JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 307/34 of the Indian Penal Code.

The accusation is of making assault to the informant, informant's daughter and son in law.

It is submitted by the learned counsel for the petitioners that the accusation has been levelled in the background of land dispute between the parties and there is counter version of the occurrence. Statement has been made in paragraph 9 of the petition that there is no injury report on record which reads as

"That the injury report of the informant side is not on record."

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for two months in the event of arrest or surrender before the learned Court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhojpur at Ara in connection with Chauri P.S. Case No.37 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail will be confirmed by the learned court below on verification of the fact that none from the informant side received any grievous injury, otherwise the petitioner shall surrender and pray for regular bail.
