JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to the prosecution case, occurrence took place on 22.02.2015 and the wife of the informant claiming herself to be an eye witness of the alleged occurrence stated that on the same day she gave information regarding the present occurrence to the informant but even then informant lodged the present case on 26.02.2015 i.e after four days of the alleged occurrence. Victim and petitioner were caught by the police and the statement of the victim was recorded under section 164 of the Cr.P.C in which she stated that she was forcibly taken away by the petitioner and confined in a room where petitioner established physical relation

The contention on behalf of the petitioner is that the victim was in love with petitioner and as a matter of fact, she eloped with the petitioner and after two months while petitioner and victim were returning to their home they were caught by the police and after that under the pressure of police and family of the victim, the victim made U-turn statement against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S.Case No. 32 of 2015.
