1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The matter has been placed for consideration of the petitioner's regular bail prayer in connection with Deepnagar P.S. Case No. 350/2021 dated 05.10.2021 registered for the offence punishable under sections 399, 402 and 420 read with section 34 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act.

3. Mr. Ganesh Sharma, learned counsel appearing for the petitioner submits that the petitioner earlier preferred Cr. Misc. No. 33798/2022 for the relief of regular bail which was rejected by this Court vide order dated 08.09.2022 with giving him a liberty to renew his bail prayer after one year

Patna High Court CR. MISC. No.9443 of 2024(3) dt.26-04-2024 2/3 from the date of that order if his trial is not concluded in the said period. Learned counsel further submits that the petitioner has been languishing in jail since 06.10.2021 in the present matter and till date his trial has not commenced and though against him, there are criminal antecedent of 8 cases but he has got bail in all the said cases.

4. Mr. Satya Nand Shukla, learned APP for the State has opposed the bail prayer of the petitioner.

5. Heard both the sides, perused the FIR and report of the trial court. Though against the petitioner, there is serious allegation, and also, criminal antecedent of several cases but considering his custody period as well as no progress in his trial which gets reflected from the trial court's report, this Court is now inclined to release the petitioner on bail. Accordingly, let the petitioner be released on bail, after framing of charge if the same has not been framed, on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Deepnagar P.S. Case No. 350/2021.

6. The learned trial court is directed to take step for framing of charge upon the petitioner, as early as possible, as
