JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kotwali P. S. Case No.360 of 2019 registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379, 427, 448, 504, 506 of the I.P.C. and Section 27 of the Arms Act. Taking into consideration that there is specific allegation against the petitioner that he assaulted the informant and also looted her belongings, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail stands rejected.

However, petitioner is directed to surrender before the

Patna High Court CR. MISC. No.5130 of 2020(2) dt.03-03-2020 2/2 Court below within six weeks from today and seek regular bail which shall be considered by the learned Court below on its own merit particularly keeping in mind that the petitioner does not have any criminal antecedent without being prejudiced by this order.
