The petitioner is in custody in a case registered under Sections 420, 406, 120B, 376, 384, 387, 504 of the Indian Penal Code.

The allegation against the petitioner is of not performing the marriage with the complainant/ informant and her ornaments had given to his own daughter at her marriage and on demand he became furious and started abusing filthily and fled away. On 10.3.2015 when she contacted the petitioner on his mobile, he started abusing filthily.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in

Patna High Court Cr.Misc. No.35863 of 2015 (3) dt.06-10-2015 2/2 custody since 13.06.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The petitioner has been made accused in this case due to mistake of fact as the same is evident from perusal of Annexure 2 to the present application as the matter has been compromised between the parties.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,West Champaran at Bettiah in Muffasil P.S.Case No. 187 of 2015.
