JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, the accused persons including the petitioner surrounded the informant and abused him. On protest, one co-accused namely, Dharmendra Singh caused fire arm injury.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and there is no specific overt act alleged against the petitioner. It is further submitted that the specific allegation of causing fire arm injury is against co-accused Dharmendra Singh. He further submitted that FIR named accused persons namely Dharmendra Singh and

Patna High Court CR. MISC. No.6463 of 2023(2) dt.11-05-2023 2/2 Vishwamitra Kumar Singh have already been acquitted on 12.04.2022 vide Sessions Trial No. 194 of 2021. The petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bikramganj in connection with Karakat P.S.
