Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the petitioners and other accused persons is of killing the father of the informant. Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case due to previous enemity and party friction prevailing in
Patna High Court CR. MISC. No.10063 of 2020(3) dt.25-06-2020 2/2 the village and there is no involvement of the petitioners in murder of the informant's father and the case diary shows that the petitioner no. 2 namely Sonu Kuamar is out of the village at the alleged period of murder.
Learned APP for the State opposes the prayer for bail petition.
In the aforesaid facts and circumstances, there is seriousness of the offence, I am not inclined to enlarge the petitioners on bail. Accordingly, the prayer for bail of the petitioners are rejected in connection with Sahar P.S. Case No. 107 of 2019 from the Court of learned C.J.M., Bhojpur at Ara. Accordingly, this application is dismissed.
However, petitioners are directed to surrender before the learned court below and make prayer for bail, the learned court below shall dispose of the bail petition on the same day without being prejudiced by this order.
