2. The petitioner seeks regular bail in connection with Kateya P.S. Case No. 108 of 2023 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302, 504, 506 of the IPC.

3. As per prosecution case, the allegation against the petitioner is to commit murder of the informant's son namely, Balister Ram along with other co-accused persons causing head and bodily injuries. The alleged occurrence took place in the background of longstanding land dispute.

4. Learned counsel for the petitioners submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to dirty village politics.

No.7904 of 2024(2) dt.20-02-2024 2/2 From perusal of FIR, the specific allegation is against coaccused Rudal Ram who assaulted the deceased by means of Farsa due to which he succumbed to injuries. No specific overtact attributed against the petitioner. Other co-accused persons have already been enlarged on bail by this Bench vide order dated 18.01.2024 passed in Cr. Misc. No. 71755 of 2023. The petitioner has got no criminal antecedents as stated in para-3 of the bail petition and languishing in judicial custody since 21.09.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kateya P.S. Case No. 108 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Gopalganj.
