The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

The informant alleged that the victim was kidnapped by some unknown persons. The victim was recovered and made her statement under Section 164 of the Cr.P.C., she disclosed that Luvkush kidnapped her after administering intoxicants and left her in a lonely place. She called Sudarshan Sah, the petitioner and thereafter solemnized marriage with him. Sudarshan Sah did not commit any illegal acts with her.

Learned counsel for the informant, however, while opposing the prayer for bail of the petitioner submitted that the

Patna High Court Cr.Misc. No.34618 of 2015 (2) dt.21-08-2015 2/2 victim is a minor girl, but the victim herself disclosed that she was not kidnapped by the petitioner nor the petitioner did any wrong acts with her.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Barhariya P.S.
