1. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the complainant/opposite party no. 2.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 384, 386, 406, 420, 467, 468, 500, 503 and 120(B) of the Indian Penal Code.

Learned counsel appearing on behalf of the opposite party no. 2 submits that the case was earlier taken up by a Coordinate Bench of this Court on 14.03.2024 when learned counsel appearing on behalf of the petitioners has sought time for seeking instruction on the point of refund of the balance amount in favour of the complainant/opposite party no. 2.

Learned counsel appearing on behalf of the petitioners submits that he has taken instruction and it is the contention of the petitioners that sale deed has been executed with respect to 3 Kathas of land and the amount of Rs.39,30,000/- has been paid by way of consideration. It is further submitted that the petitioners had never agreed to sell 6 Kathas of land nor there is any agreement for sale to that effect. It is next submitted that petitioners will contest the case in the trial to prove their innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 7854(C) of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
