The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 411, 34 of the Indian Penal Code and section21 of the Mines Minerals (D & R) Act and 56 of the Bihar Minerals Act. As per the prosecution case, petitioner is involved in illegal storage and transportation of illegally mined sand. It is submitted that petitioner has got no concern with the illegally mined sand stored at different places of Mauza Kukiyasin. Petitioner has been falsely implicated in this case on the basis of identification by the local Chowkidar. Considering the facts aforesaid, the petitioner above-

No.7764 of 2023(2) dt.18-04-2023 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XI, Gaya in connection with Buniyadganj P.S. Case No. 232 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
