1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Sessions Trial no.582 of 2024, arising out Alamganj P.S. Case no. 1009 of 2023 registered under sections 302, 307, 341, 324, 326 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, the informant states that while her father was having food at night, she heard sound of firing. On going out of the house she found firing being exchanged from two sides and she identified the accused persons including the petitioner herein. It is stated that her father sustained gunshot injury in the said cross firing.

4. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide

Patna High Court CR. MISC. No.10084 of 2025(3) dt.21-02-2025 2/2 order dated 26.7.2024 (Annexure-P-1) passed in Cr. Misc. no. 30536 of 2024 giving liberty to the petitioner to renew his prayer for bail after completing one year in custody. The petitioner has remained in custody for more than one year since 27.1.2024 and has no criminal antecedent. He undertakes to cooperate in the case/trial.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the liberty granted to the petitioner in the earlier order of rejection dated 26.7.2024, the petitioner having remained in custody for more than 1 year since 27.1.2024 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no.582 of 2024 (arising out of Alamganj P.S. Case no. 1009 of 2023) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Patna City, Patna.
