2. This is the second attempt of the petitioner for grant of regular bail in connection with Gopalpur P.S. Case No. 95 of 2023 registered for the offence under Sections 302, 201, 376(D)A read with Section 34 of the Indian Penal Code and under Section 4, 6 of the POCSO Act. Earlier the bail application of the petitioner was rejected vide order dated 29.02.2024 passed in Cr. Misc. No. 75894 of 2023.

3. As per the prosecution case, the dead body of the deceased has been recovered from the house of the

4. The petitioner is in custody since 6.7.2023 and it has been submitted by the learned counsel for the petitioner that in the trial, out of eight charge-sheeted witnesses only one witness has been examined.

5. Learned counsel for the petitioner further submits that charge-sheet has been submitted under Section 306 of the Indian Penal Code and the petitioner is ready to cooperate in the trial.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned I/c Additional Sessions Judge-VI-cum-Spl. Judge, POCSO, Bettiah, West Champaran/concerned Court below in connection with Gopalpur P.S. Case No. 95 of 2023.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Gopalpur Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
