The petitioner seeks bail in a case registered for the offence under Sections 341, 328, 307, 354(B), 498(A), 504, 34, 494 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have committed torture and assaulted his wife (informant) by fists and legs and thereafter, ousted her from the matrimonial house. It is further alleged that this petitioner also solemnized another marriage.

It is submitted on behalf of petitioner that no such occurrence, as alleged in the F.I.R., has taken place. In fact, prior to the present case, this petitioner filed a matrimonial case in the court of learned Principal Judge, Family Court,

Patna High Court CR. MISC. No.6489 of 2022(2) dt.07-04-2022 2/2 Aurangabad under Section 13 of the Hindu Marriage Act for dissolution of marriage. It is further submitted that petitioner denies the fact that he has solemnized second marriage. Petitioner is ready to keep informant/opposite party no.2, as his wife, with full honour & dignity and he is in custody since 20.11.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Aurangabad in connection with Simra P.S. Case No. 24 of 2021. (Prabhat Kumar Singh, J) anay/- U T
