JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Special Case No. 6806 of 2018, arising out of Alamganj P. S. Case No. 394 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per F.I.R. there is recovery of 725 liters of Toddy from one Tata Magic vehicle and the vehicle is in the name of one Sanjay Kumar and the name of the petitioner was disclosed by co-accused stating that same has been brought for one Gupta. Submission of the learned counsel for the petitioner is that except that there is allegation against the petitioner that his house was raided and there is also no other allegation has been attributed against him.

Having heard both sides, considering the above
Patna High Court CR. MISC. No.6308 of 2019(4) dt.24-09-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 6806 of 2018, arising out of Alamganj P. S. Case No. 394 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
