Having regard to the fact that the prayer for bail of the petitioner was earlier rejected on 07.10.2013 in Criminal Miscellaneous No. 29320 of 2013, this Court is not inclined to once again go into the issue of grant of bail on merit.

From the report of the Court below at 'Flag-B' dated 10.08.2015, it transpires that the trial of the petitioner has already commenced and three witnesses have been examined. The report of the trial Court dated 10.08.2015, also goes to show that the last witness was

Patna High Court Cr.Misc. No.35397 of 2014 (3) dt.27-08-2015 examined on 08.07.2015.

That being so, this Court would direct the trial Court as also to the Superintendent of Police, Lakhisarai to ensure that the remaining eight witnesses out of total eleven of the prosecution witnesses in Halsi P.S. Case No. 131 of 2012 giving rise to Sessions Trial No. 723 of 2013, must be examined within a period of six months so that the trial of the petitioner is concluded within a period of nine months from the date of receipt of this order.
