JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448,354,354D,504,506 and 509/34 of the Indian Penal Code.
It is alleged that the petitioner entered into the house of the informant, inquired about the father of the informant and finding no body in the house, the petitioner tried to outrage the modesty of the informant.
It is submitted by the learned counsel for the petitioner that at earlier point of time the cousin of the petitioner lodged Sabour P.S. Case No. 56 of 2014 making accusation under sections 366A/34 IPC against the father of the informant, hence as a retaliatory measure, the present case has been lodged. It is
Patna High Court Cr.Misc. No.34700 of 2015 (2) dt.01-09-2015 2/2 further submitted that for the occurrence of 25.11.2014 the FIR has been registered on 18.1.2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the case lodged by petitioner side at earlier point of time, delayed lodging of the case and Statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Sabour P.S. Case No. 9 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
