The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, 72 litres of liquor was recovered from the vehicle and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or from his vehicle. He has been falsely implicated in the case. He is in custody since 29.11.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Excise Case no. 335 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge II - cum - Special Judge, Excise, Gopalganj subject to the condition that one of the bailors of the petitioner shall be a close relative of the petitioner and the other bailor shall be a resident of an area within the territorial jurisdiction of the learned trial Court.
