The petitioner seeks bail in Baligaon P.S. Case No. 137 of 2021, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, on 03.12.2021 at about 1.00 am petitioner along with co-accused Rajesh Kumar entered into the house through the window and poured acid inside the house. It is further alleged that they sprinkled petrol through the window and lighted the house due to which various articles got damaged and while fleeing away from the place of occurrence petitioner was apprehended.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to

Patna High Court CR. MISC. No.7196 of 2022(2) dt.07-04-2022 2/2 previous enmity and grudge between the parties. In fact, petitioner was returning after attending a function and on suspicion he has been caught by the family of the informant. Petitioner is in custody since 05.12.2021 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that this petitioner was apprehended on the spot and there is specific allegation against him that he threw acid inside and lighted the house. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
