The petitioner is seeking anticipatory bail in connection with Kharik P.S. Case No. 99/2018 registered under Sections 392 of the Indian Penal Code and order dated 03.08.2018 Section 412 of the Indian Penal Code was added. Learned counsel for the petitioner submits that the petitioner is not named in the first information report, no recovery has been made from his possession and he is a man of clean antecedent. The name of the petitioner has transpired in the confessional statement of the co-accused. Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.14575 of 2019(2) dt.12-03-2019 2/2 whereunder the petitioner is having clean antecedent and nothing has been recovered from his possession, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - 1st, Naugachia, District - Bhagalpur, in connection with Kharik P.S. Case No. 99/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation.
