2. The petitioner is apprehending his arrest in connection with Sonepur P.S Case No. 303 of 2023 dated 01.05.2023 registered for the offence punishable u/s 341, 323, 324/34 of the Indian Penal Code and 3⁄4 of Explosive substance Act.

3. As per the prosecution case, due to some previous land disputes between petitioner and informant, the petitioner and other co-accused person are alleged to have threw bomb on the informant's house due to which the informant's son got injury on his leg.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.10587 of 2024(2) dt.13-03-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that during investigation police did not found any evidence about explosion of bomb throw by the petitioner. The nature of the injury is not mentioned in the impugned order dated 04.01.2024. The petitioner has two criminal antecedents as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioner and submitted that the injured sustained injury on his leg.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Sonepur P.S Case No. 303 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

8. This application stands allowed.
